These Terms of Use (“Terms”) are a legally binding agreement between you and Zoe Life LLC (“Speak to Zoé,” “we,” “us,” or “our”), located at 42 Broadway, New York, NY 10004, United States. They govern your use of the Speak to Zoé mobile app for iOS and Android and the website speaktozoe.com (together, the “Services”).
By creating an account or using the Services, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. Section 21 contains a binding arbitration agreement and class action waiver that affect how disputes are resolved.
1. The Services
Speak to Zoé is a voice-first journal for your spiritual life. It lets you record dreams, prayers, impressions and Scripture reflections; transcribes them; offers AI-generated interpretations and reflections; keeps a lexicon of biblical, universal and personal symbols; and helps you notice patterns over time.
Some features require a paid subscription or an invitation code (“Full Access”). Features, content and availability may change over time.
2. Eligibility
You must be at least 18 years old, and able to form a binding contract, to create an account or use the Services. The Services are not directed to children. By using them, you confirm that you meet these requirements.
3. Your account
- You must provide accurate information when you sign up, including an email address you can access to confirm your account.
- Keep your password confidential. You are responsible for activity under your account; tell us promptly at team@speaktozoe.com if you believe it has been accessed without your permission.
- Your account is for your personal use and may not be shared, sold or transferred.
4. Your journal and content
Your journal is yours
Your recordings, transcripts, entries, symbols and the interpretations generated from them (“Journal Content”) belong to you and are private to your account. They are never shown to other users and are never published, sold, licensed, or used for advertising.
The permission you give us
You grant us a limited, non-exclusive, revocable permission to store, process and display your Journal Content only as needed to provide the Services to you — for example to transcribe your recordings, generate interpretations and pattern analyses, learn your personal symbols, and make your journal available across your devices. This permission ends when you delete the content or your account.
Your responsibility
You are responsible for the content you record and must have the right to record it. Do not record other people without any consent the law requires.
5. AI-generated content
Transcriptions, interpretations, summaries, symbolic breakdowns, discernment notes and pattern analyses in Speak to Zoé are generated automatically by artificial intelligence from the content you record, using third-party AI services described in our Privacy Policy.
AI-generated content is a prompt for your own reflection, prayer and discernment. It is not prophecy, revelation, spiritual direction, counseling, or professional advice, and it is not a substitute for pastoral care, medical advice, mental health treatment, or any other professional service. It may be inaccurate, incomplete, or unsuitable, and you are responsible for how you interpret and act on it. Weigh it against Scripture and wise counsel.
If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis line right away (in the US, call or text 988).
You can report any interpretation you find offensive, harmful or inaccurate from the entry screen in the app. We review reports and use them to improve the Services.
6. Subscriptions, free trials and billing
Full Access subscription
Full Access is an auto-renewing subscription, available as a monthly or annual plan. Prices are shown in the app before you buy and may vary by country.
Billing and automatic renewal
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or when a free trial ends.
- Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
Free trials
We may offer a free trial to new subscribers. Whether a trial is available, and its length, is shown in the app before purchase and is determined by Apple or Google; a trial is generally available once per Apple ID or Google account. If you do not cancel at least 24 hours before the trial ends, the subscription begins automatically and you are charged for the plan you selected.
Cancelling
You can cancel at any time. Cancellation takes effect at the end of the current paid period.
- iPhone or iPad: Settings → your name → Subscriptions → Speak to Zoé → Cancel Subscription
- Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions → Speak to Zoé → Cancel
Deleting the app or your account does not cancel your subscription — cancel it with Apple or Google as shown above.
Price changes
We may change subscription prices. Apple or Google will notify you in advance as required, and, where the law requires, ask for your consent before a higher price applies.
7. Refunds
Subscriptions are purchased from Apple or Google and are subject to their refund policies. Refund requests must be made to Apple (reportaproblem.apple.com) or Google Play directly; we cannot issue refunds for store purchases. Except where required by law, fees already paid are non-refundable. Consumers in the European Union, the United Kingdom and other places with mandatory consumer protection laws keep any statutory rights of withdrawal or refund.
8. Invitation codes
We may give invitation codes that grant Full Access without a subscription. Each code can be used once, when creating an account. Invitation codes are personal, have no cash value, and may not be sold or transferred. We may withdraw access granted by a code if it was obtained or used in breach of these Terms, and we may end the invitation program at any time, with notice where reasonable.
9. Apple App Store and Google Play
If you downloaded the app from the Apple App Store or Google Play, these Terms are between you and Zoe Life LLC only — not Apple Inc. or Google LLC — and we alone are responsible for the app and its content. Your use of the app must also comply with the store’s terms of service.
- For apps obtained from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies; if it conflicts with these Terms, these Terms control to the extent permitted.
- Apple and Google have no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple and Google are not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or intellectual property infringement claims.
- You confirm that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Acceptable use
You agree not to:
- use the Services for anything unlawful, or to harass, threaten or harm others;
- attempt to access another person’s account or data, or our systems without permission;
- interfere with, overload, or disrupt the Services or their security features;
- copy, reverse engineer, decompile or resell the Services, except where the law expressly allows;
- use bots, scrapers or other automated means to access the Services;
- use the Services, or their AI features, to create content that is illegal, sexually exploitative, or intended to harm;
- misuse, sell or share invitation codes, or circumvent subscription or access controls.
We may suspend or close accounts that break these rules.
11. Our intellectual property
The Services — including the app, website, software, design, text, graphics, the symbol lexicon, and the Speak to Zoé name and logos — are owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial purposes. All rights not expressly granted are reserved.
12. Feedback
If you send us ideas, suggestions or feedback about the Services, we may use them without restriction or compensation to you. Feedback does not include your Journal Content, which remains yours.
13. Third-party services
The Services rely on third-party services, such as AI providers, payment processors and video hosting, and may link to third-party websites. We are not responsible for third-party services or content we do not control, and your use of them may be subject to their own terms.
14. Privacy
Our Privacy Policy explains how we handle your information and forms part of these Terms. The Services are hosted in the United States; by using them from elsewhere, you understand that your information will be transferred to and processed in the United States.
15. Deleting your account and termination
Deleting your account
You can delete your account at any time in the app under Settings → Account → Delete account, or as described at speaktozoe.com/account-delete. Deletion is permanent and removes your Journal Content. It does not cancel a subscription bought through Apple or Google — cancel that as described in Subscriptions.
Suspension or termination by us
We may suspend or close your account, or limit your access, if you seriously or repeatedly breach these Terms, if required by law, or to protect users or the Services. Where reasonable, we will tell you why and give you a chance to export your journal first. If we close your account without cause, we will do our best to help you get a refund of any unused subscription period from the store.
16. Changes to the Services and these Terms
We may update, change or discontinue parts of the Services. We may also update these Terms; we will change the “Last updated” date and, for material changes, notify you in the app or by email before they take effect. If you continue to use the Services after changes take effect, you accept the updated Terms. If you do not agree, stop using the Services and delete your account.
17. Disclaimer of warranties
To the fullest extent permitted by law, the Services and all content, including AI-generated content, are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, or that any content is accurate or reliable.
18. Limitation of liability
To the fullest extent permitted by law, we and our officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Services, even if advised of the possibility. Our total liability for any claim related to the Services will not exceed the greater of the amount you paid for the Services in the twelve (12) months before the claim arose, or one hundred US dollars (US$100).
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you, and you may have additional rights. Nothing in these Terms limits liability that cannot be limited by law.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Services, or your violation of the rights of others.
20. Governing law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise. Consumers in the EU, the UK and other jurisdictions keep the protection of the mandatory laws of the country where they live.
21. Dispute resolution
Informal resolution first
Before starting any formal proceeding, please contact us at team@speaktozoe.com so we can try to resolve the dispute informally. Both of us agree to try for at least thirty (30) days after written notice.
Binding arbitration
If we cannot resolve a dispute informally, it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may take place by video, by phone, on written submissions, or in Illinois. Your filing fees will not exceed what the AAA Consumer Rules provide. You and we each waive the right to a jury trial and to participate in a class action or class-wide arbitration.
Exceptions
Either of us may bring an individual claim in small claims court, and either of us may seek injunctive relief in court to protect intellectual property or to stop unauthorized use of the Services. Any court proceeding will be brought in the state or federal courts located in Illinois, unless the law of your place of residence entitles you to bring it where you live.
Time limit
To the extent permitted by law, any claim must be brought within one (1) year after it arises. This section does not apply where the law of your place of residence prohibits it.
22. Electronic communications
You agree to receive communications from us electronically, including by email and in the app, and agree that these satisfy any legal requirement that communications be in writing.
23. California users
Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
24. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
